With the activation of ENFIA (Single Property Tax) Law 4223/2013, for each transfer of property, a certificate is requested in which the property is mentioned with its full details and receives a unique number to be used by the notary.
The source of the data mentioned in the certificate is the taxpayer’s property status(E9 declaration) and the property identification number (ATAK) is a necessary element for the issuance of the certificate.
The certificate requested relates to the last five years if the property has been in the taxpayer’s possession , otherwise to the number of years it has been in the taxpayer’ s possession (e.g. 4 years or less).
This certificate is requested by the notary to complete the transfer of a property together with other documents.
For this reason, cooperation between a notary and a tax advisor is required so that the description and the details of the property in the certificate and E9 correspond to the title deeds on the basis of which the transfer is made.
The reason why the certificate is requested (e.g. parental provision, transfer by force majeure, etc.) is required for the issuance of the certificate.
Many times it is observed that the taxpayer fails to fill in the property details correctly (e.g. wrong surface area, wrong location, etc.) due to difficulties in filling in the form and a correction is required in the property status (through the E9 form) and a new certificate is issued with the correct details, based on notarial and other documents.
As a consequence, the transfer process is delayed until the correction and clearance of the E9 declaration and the issue of the relevant certificate is completed.
